Family, Inheritance, and Divorce Practice

Family law governs legal issues arising from personal relationships, marriage, and succession. In India, different statutes apply depending on personal law, such as the Hindu Marriage Act, 1955, the Special Marriage Act, 1954, and the Hindu Succession Act, 1956, among others. Family law practice frequently involves matrimonial disputes, custody of children, inheritance claims, and succession matters.

Divorce and matrimonial disputes may involve petitions for dissolution of marriage, judicial separation, restitution of conjugal rights, and annulment. Issues of maintenance, alimony, and custody require sensitivity as well as adherence to statutory standards prioritizing welfare of the child. Inheritance and succession matters include partition suits, challenges to wills, and disputes over ancestral or self-acquired property.

Proceedings are generally conducted before Family Courts, District Courts, and in appeal before High Courts. Representation includes drafting of petitions, applications, and responses, along with appearances in evidence and argument. Where possible, settlement is encouraged through mediation, particularly in matters affecting family relations.

Family law practice requires not only technical knowledge but also empathy and discretion, given the personal and sensitive nature of disputes.
